This Distance Sale Agreement sets out the conditions for private tours, guiding, transfers and other agreed travel services booked remotely with Romos Travel through Private Tour Ephesus. It must be read together with the booking-specific information supplied before payment, your written confirmation and our Terms and Conditions.

A person booking for other participants must be authorised to do so and must communicate the relevant arrangements and safety requirements to the group. The customer and the participating guests may be different people.
2. Scope and booking-specific information
This agreement concerns the tour and any additional services expressly agreed in writing. It is intended for tour bookings and does not impose product-delivery, cargo-return or physical-goods conditions on a service.
Before accepting a booking or requesting payment, we will supply the applicable booking details in a form you can retain, such as email. These details identify:
- The customer, relevant contact and billing information, and booking reference when issued.
- The experience, date, departure time, duration, meeting point, group size and confirmed guide, transport and other service arrangements.
- The included services, exclusions, agreed extras and any material restrictions.
- The total price including applicable taxes, currency and any separately disclosed additional charges.
- The payment method, deposit requirement, balance deadline, cancellation conditions and any booking-specific variation agreed in advance.
This public page is the general agreement; it does not itself contain your individual booking details or reserve a guide or vehicle. Keep the quotation, pre-contract information, accepted conditions, payment records and confirmation together.
3. Formation of the booking
An enquiry is not a confirmed reservation and does not create a payment obligation. A quotation is subject to the availability and validity conditions stated in it. Your booking is confirmed when we issue written confirmation after receiving the required payment and agreeing the relevant arrangements.
Before you accept a paid booking, the amount and payment obligation must be made clear. We do not treat merely visiting this website, sending an enquiry or reading this agreement as acceptance of a paid contract. We will provide a copy of the applicable conditions and confirmation in a form that you can save.
Please check the details and promptly report any error. A material price or availability error will be explained before we seek your agreement to corrected arrangements; we do not reserve an unrestricted right to change an agreed contract unilaterally.
4. Price and payment
The price, deposit and balance-payment deadline are those specified in your booking documents. A cancellation percentage is not a statement of the deposit amount. Only expressly confirmed services are included. Transfers, meals, accommodation, admission fees and additional guiding or vehicle hours are extra unless listed as included.
Payment methods may include credit card, bank transfer or cash where agreed for the booking. Bank transfers must be received by the agreed deadline; please allow time for processing. Any applicable payment charges must be disclosed before you agree to pay them. Optional extras require your agreement.
Payment providers and banks process card transactions under their own arrangements. Additional verification may be required for a non-travelling cardholder. Do not send full card numbers or security codes through the enquiry form or ordinary email. A payment failure or chargeback will be investigated; it does not remove either party's rights or responsibilities under the confirmed contract and applicable law.
5. Delivery of the service
The tour will be provided on the date and under the arrangements confirmed in writing. Meeting and pickup instructions will be communicated before departure. Guests must arrive at the agreed time and contact operations promptly if delayed. Late arrival may shorten a tour where a guide or vehicle has another booking; extra time cannot be guaranteed.
Traffic, weather, official restrictions, site opening hours and religious services can affect the sequence of visits. The guide may make reasonable practical adjustments. Material changes to agreed services require an appropriate remedy and, where required, your agreement. Follow reasonable safety and site instructions and supervise accompanying children. Tell us about accessibility requirements before booking so we can discuss suitability.
6. Guest cancellation and no-show
The following general cancellation schedule applies to the total confirmed booking price, except components governed by special conditions disclosed and accepted before purchase, and subject to the mandatory rights below:
| Calendar days before the service starts | Cancellation charge |
|---|---|
| 16 days or more | 30% |
| 6–15 days | 50% |
| 3–5 days | 70% |
| 2 days or fewer, or no-show | 100% |
Days are calendar days, calculated by the difference between the scheduled service start date and the date we receive the written cancellation, both in Türkiye local time (Europe/Istanbul). The service date is day zero. Send requests to info@privatetourephesus.com; retain proof and follow up if acknowledgement is delayed.
Flights and supplier-specific services: Airline fare rules and the cancellation conditions of hotels, balloon operators and other providers may differ according to the purchased package. We must identify the affected components and disclose their relevant conditions before you accept and pay. A separately agreed component-specific charge replaces the general charge for that component; we do not impose both on the same service. Charges are explained and itemised, refundable amounts are credited, and a charge does not exceed the confirmed price of its component. Any refund or balance is calculated after crediting payments already received. A deposit amount is distinct from the cancellation percentage.
Mandatory package-tour protections
Where the booking qualifies as a package tour under applicable Turkish law, mandatory package-tour rules prevail over this general schedule and over conflicting supplier conditions. Under Article 16 of the Package Tour Contracts Regulation, cancellation notified at least 30 days before departure entitles the participant to a refund without deduction other than compulsory taxes, levies and similar statutory expenses. For shorter notice, any permitted charge must have been stated in the package-tour contract. Where the statutory conditions for unavoidable, unforeseeable circumstances or force majeure are met, only the deductions permitted by that provision may be made, including qualifying documented, non-refundable third-party payments. Refunds under that provision are due within 14 days of receipt of the cancellation notice.
Rights relating to non-performance, defective service, provider cancellation and other mandatory protections remain unaffected. Later website revisions do not retrospectively replace terms already agreed for an existing booking.
7. Statutory withdrawal and contractual cancellation
A statutory cooling-off right is different from the contractual cancellation conditions above. Under Article 15(1)(g) of Türkiye's Distance Contracts Regulation, the ordinary withdrawal right does not apply to qualifying leisure services that must be provided on a specified date or during a specified period. A fixed-date private leisure tour will generally fall within this category. We will disclose the applicable position before you accept the booking.
This exception must not be applied indiscriminately to every service or voucher. If the exception does not apply and a statutory withdrawal right is available, the applicable statutory procedure and time limit prevail over a cancellation charge. For a service contract subject to the ordinary right, the withdrawal period is generally 14 days from conclusion of the contract.
Where a statutory withdrawal right applies, you may exercise it through an unequivocal written statement or another legally permitted durable medium, including email to the address above. State your name, booking reference, service and that you are withdrawing. An original paper invoice is not imposed as a condition of exercising that right. Nothing here restricts rights relating to a service that is not provided, is defective or does not conform to the agreement.
8. Changes, inability to perform and refunds
A requested change of date, guide, transport, duration or group size is subject to availability and written agreement. Any price difference or applicable charge will be explained before you accept the change. If a change cannot be agreed and you cancel, the relevant cancellation conditions apply, subject to mandatory law.
If safety restrictions or other circumstances prevent us from providing the confirmed service, we will inform you promptly and discuss available alternatives. A materially different service requires your agreement. Where performance becomes impossible and the applicable distance-contract rules require it, we will notify you within three days of learning of the situation and return the payments due within 14 days of notification.
Refunds will be made through an appropriate payment method in accordance with applicable requirements. For a valid statutory withdrawal, the statutory refund deadline applies. Bank posting times can vary; this does not remove our obligation to initiate a refund within the required period. We do not require you to waive statutory claims in exchange for a refund that is legally due.
9. Exceptional circumstances and responsibility
If an event beyond a party's reasonable control affects performance, that party must inform the other as soon as reasonably possible. We will assess the effect on the particular booking and the options available. The description “force majeure” does not automatically justify keeping payment for services we cannot provide or excluding mandatory consumer rights.
We remain responsible for our own contractual and legal duties when suppliers assist in delivering a booking. No provision excludes liability that cannot lawfully be excluded or places every tax, loss or risk on the customer regardless of the circumstances.
10. Personal information and communications
We use booking and contact information to answer enquiries, deliver the agreed services, administer payments and records, and meet applicable obligations. Necessary information may be shared with relevant suppliers and technology providers as explained in our Privacy Policy. Optional website analytics is described in our Cookie Policy.
Accepting a booking does not itself provide consent to unrelated promotional messages or optional analytics. Please use the contact details above for booking changes, cancellations, assistance or privacy questions.
11. Complaints and dispute resolution
Please contact our team promptly if a problem arises so that we have an opportunity to assist. A written complaint should identify the booking and the issue. This does not limit your right to seek legal redress.
Turkish law applies subject to any mandatory consumer protections applicable to the booking. Consumers may apply to the competent Consumer Arbitration Committee or consumer court, as appropriate under the applicable jurisdiction and monetary rules. No clause restricts a consumer to Istanbul courts where mandatory law provides another competent forum.
12. Records and acceptance
The booking-specific pre-contract information, accepted agreement, written confirmation and agreed variations form the record of the booking. General website updates do not automatically change an existing contract. Mandatory legal rights prevail over any inconsistent provision.
Read the booking details and applicable conditions before accepting a paid reservation. Please retain the documents sent to you. Contact us before payment if any term or arrangement is unclear.
Shore excursions and regional travel
For cruise-port pickups, provide the ship name, scheduled docking and all-aboard times and tell us promptly about changes. The itinerary and return arrangements must be confirmed for your sailing. Port access, traffic, site closures and ship schedules can affect visits; this page does not promise an unconditional ship-return guarantee. If the ship cannot dock or the operator changes the schedule, contact us immediately so we can assess rescheduling and any refund due under the accepted booking conditions and mandatory law.
